Press releases and texts of the judgments will be available at 10 a.m. (local time) on the Court's Internet site (www.echr.coe.int) Tuesday 28 August 2012 Costa and Pavan v. Italy (application no. 54270/10) The applicants, Rosetta Costa and Walter Pavan, are Italian nationals who were born in 1977 and 1975 respectively and live in Rome. They are healthy carriers of the genetic disease cystic fibrosis who want to have a baby by in vitro fertilisation, so that the embryo can be genetically tested before it is used to start a pregnancy. Under Italian law, however, this is not permitted. Relying on Article 8 (right to respect for private and family life), they complain that the only course open to them is to start a pregnancy by natural means and medically terminate it every time the foetus tests positive for the disease. Under Article 14 (prohibition of discrimination), they claim that they are the victims of discrimination compared with sterile couples or those where the man has a sexually transmissible disease. Spampinato v. Italy (no. 69872/01) Just satisfaction The applicants, Giuseppe and Santa Spampinato, are Italian nationals. In a judgment of 5 October 2006 the Court found that the loss of the use of their land (which had been taken over by the authorities and on which construction work had been started), combined with the lack of any possibility of remedying the situation, amounted to a de facto expropriation incompatible with the applicants' right to protection of their property under Article 1 of Protocol No. 1 (protection of property). The Court reserved the question of the application of Article 41 (just satisfaction), which will be examined in the judgment delivered on 28 August 2012. Vuckovi and Others v. Serbia (no. 17153/11 and 29 other applications) The applicants are 30 Serbian nationals who mostly live in the Nis region (Serbia). As reservists drafted by the Yugoslav Army, they were granted a per diem expenses allowance for their service between March and June 1999 during NATO's intervention in Serbia. Relying on Article 1 of Protocol No. 1 (protection of property), Article 14 (prohibition of discrimination) and Article 1 of Protocol No. 12 (general prohibition of discrimination), they complain of discrimination and inconsistent case-law of the Serbian courts concerning the payment of that allowance. Ahmet Duran v. Turkey (no. 37552/06) The applicant, Ahmet Duran, is a Turkish national who was born in 1953 and lives in Van (Turkey). Arrested in April 2005 on suspicion of being involved in trafficking of illegal immigrants, he alleges that he was ill-treated during the first hours of his custody at the Caldiran district gendarmerie command, before he was brought before a doctor for the first time. He also argues that the investigation into his allegations of ill-treatment was ineffective. He relies on Article 3 (prohibition of inhuman or degrading treatment). Fazli Diri v. Turkey (no. 4062/07) The applicant, Fazli Diri, is a Turkish national who was born in 1960 and lives in Trabzon (Turkey). When he worked as a guard on a private bank's security van, criminal proceedings were brought against him in 1998 for breach of trust after money went missing from his van. He complains that, despite those proceedings against him having been suspended in 2003, in subsequent civil proceedings he brought claiming compensation for his dismissal the courts found him guilty of breach of trust as well as of another offence � embezzling the missing money � of which he had never actually been accused.
