W grudniu 2010 roku został wydany Maroku i natychmiast zatrzymany w oczekiwaniu na proces. W październiku 2012 roku Sąd Apelacyjny w Rabacie skazał go na 12 lat więzienia. Aarrass v. Belgium (application no. 16371/18)
The applicant, Ali Aarrass, is a joint Belgian and Moroccan national who was born in 1962. He was arrested on 1 April 2008 in Melilla (Spain) under an international arrest warrant issued against him by the Moroccan authorities in order that he could be tried in that country on charges of criminal conspiracy, belonging to a terrorist organisation, and carrying out terrorist attacks likely to cause a breach of the peace. In December 2010 he was extradited to Morocco and immediately detained pending trial. In October 2012 the Rabat Court of Appeal sentenced him to 12 years' imprisonment. After serving his sentence, he was released in April 2020 and he subsequently returned to Belgium on 15 July 2020.
In this case, relying on Articles 1 (obligation to respect human rights) and 3 (prohibition of torture, inhuman or degrading treatment) of the European Convention on Human Rights, Mr Aarrass alleges that the Belgian State failed to comply with its positive obligation to provide him with consular protection in order to attempt to end the serious breaches of his physical and psychological integrity to which he had been subjected while imprisoned in Morocco.
Demokrat Parti v. Turkey (no. 8372/10)
The applicant, Demokrat Parti ("Democrat Party"), is a political party which has its headquarters in Ankara. At its annual conference in 2009 the political party Anavatan Partisi ("ANAP", the Motherland Party) decided to merge with the applicant party, under the latter's name, that is, Demokrat Parti.
The case concerns the refusal by the Ministry of Finance to pay the applicant � a political party � public funding for the year 2006, following the repeal in May 2005 of section 16 of Law no. 2820 on the regulation of political parties.
Relying on Articles 11 (freedom of assembly and association) and 14 (prohibition of discrimination), the applicant considers that there has been a breach of its right to freedom of association and that it was discriminated against, in that this funding was paid to other political parties. It also submits that this discrimination gave rise to inequality between the various political parties taking part in the electoral campaign.
The Court will give its rulings in writing on the following cases, some of which concern issues which have already been submitted to the Court, including excessive length of proceedings.
These rulings can be consulted from the day of their delivery on the Court's online database HUDOC.
