Zagadnienie prawne
Dokument nie przedstawia pojedynczego zagadnienia prawnego do rozstrzygnięcia, lecz zapowiada orzeczenia w wielu sprawach dotyczących różnorodnych kwestii konwencyjnych, takich jak dostęp do sądu, prawo do rzetelnego procesu, prawo do edukacji, zakaz dyskryminacji oraz obowiązek państwa do skutecznego śledztwa w przypadku przestępstw z nienawiści.Stan faktyczny
Komunikat prasowy opisuje kilka nadchodzących spraw. W sprawach przeciwko Albanii (Meli i Swinkels Family Brewers N.V.) skarżący zarzucają odmowę dostępu do sądu i niewystarczające uzasadnienie decyzji w związku z odrzuceniem ich skarg konstytucyjnych, dotyczących sporu o ziemię i naruszenia znaku towarowego. W sprawie Djeri i Inni przeciwko Łotwie, skarżący, należący do mniejszości rosyjskojęzycznej, kwestionują zmiany w prawie zwiększające użycie języka łotewskiego w przedszkolach, co miało ograniczyć użycie języka rosyjskiego. W sprawie Hanovs przeciwko Łotwie, skarżący padł ofiarą ataku homofobicznego, a władze krajowe nie przeprowadziły skutecznego śledztwa ani nie postawiły zarzutów karnych, uznając incydent jedynie za drobne chuligaństwo.Pełny tekst orzeczenia

Meli and Swinkels Family Brewers N.V. v. Albania (applications nos. 41373/21 and 48801/21) The applicants, Astrit Meli and Swinkels Family Brewers N.V., are respectively an Albanian national who was born in 1959 and lives in Tirana, and a limited liability company based in Lieshout (the Netherlands). It was previously known as Bavaria N.V. and it produces alcoholic and non-alcoholic drinks. The case concerns the rejection of the applicants' constitutional complaints in separate proceedings by the Constitutional Court. Mr Meli's case concerned a land dispute, while Swinkels Family Brewers' concerned alleged trademark infringement of its energy drink brand B-52. Relying on Article 6 1(right to a fair trial) of the European Convention on Human Rights, the applicants complain that the refusal to hear their constitutional complaints denied them access to a court, and that the Constitutional Court's and the ordinary courts' reasoning in the relevant decisions was inadequate. Mr Meli also alleges under Article 6 1 that there was an issue with equality of arms before the Albanian courts.

Djeri and Others v. Latvia (nos. 50942/20 and 2022/21) The applicants are two adult Latvian nationals, born in 1978 and 1990, two adult "permanently resident non-citizens" of Latvia born in 1976 and 1977, and five Latvian-national minors born between 2014 and 2020. They are parents and children who identify themselves as belonging to the Russian-speaking minority in Latvia, and live in various parts of Latvia. The case concerns 2018 amendments to the law whereby the use of the State language Latvian was increased in all pre-schools and the use of Russian was consequently reduced. The applicants rely on Article 2 of Protocol No. 1 (right to education) and Article 8 (right to respect for private and family life) of the European Convention, taken alone and in conjunction with Article 14 (prohibition of discrimination).
Hanovs v. Latvia (no. 40861/22) The applicant, Deniss Hanovs, is a Latvian national who was born in 1977 and lives in Riga. The case concerns a homophobic attack against Mr Hanovs in 2020. He and his partner had been out walking their dog when a man had started shouting at them, using offensive language and anti-gay slurs. The man attempted to strike Mr Hanovs, who sought refuge in a nearby shop, while his
partner called the police. The attacker was later found guilty of "petty hooliganism" in administrative-offence proceedings and given a 70 Euro fine. No criminal charges were ever brought.
Relying on Article 3 (prohibition of inhuman or degrading treatment), Article 8 (right to respect for private and family life) and Article 14 (prohibition of discrimination) of the Convention, Mr Hanovs complains that the authorities failed to carry out an effective investigation, and to prosecute, what amounted to a homophobic hate crime. He argues in particular that although he had escaped physical harm, the incident had been intimidating and humiliating.
The Court will give its rulings in writing on the following cases, some of which concern issues which have already been submitted to the Court, including excessive length of proceedings.
These rulings can be consulted from the day of their delivery on the Court's online database HUDOC.
They will not appear in the press release issued on that day.
