Kaya v. Belgium (application no. 10089/18) The applicant is a Belgian national who was born in 1965 and lives in Belgium. The case concerns criminal proceedings in which the applicant was convicted of social-security fraud. He alleges that the principles of impartiality and the presumption of innocence were not complied with during those proceedings. Specifically, the applicant complains of a lack of impartiality on the part of the Court of Cassation, arguing that one of the judges who examined his appeal on points of law in 2017 had been president of the criminal court division which, in 2010, had ruled on the merits of the charges against him and had convicted him. He also complains about statements made to the press during the appeal proceedings by the prosecutor who had been responsible for the proceedings against him before the criminal court. He relies on Article 6 � 1 (right to a fair trial) and 6 � 2 (presumption of innocence) of the European Convention on Human Rights.
J.S. v. Slovakia (no. 35767/23) The applicant, J.S., is a Slovak national who was born in 1980 and lives in Presov (Slovakia). The case concerns an alleged failure by the national authorities to effectively investigate and prosecute acts of domestic violence that J.S. allegedly suffered at the hands of her former husband. It also concerns the discriminatory impact of gender-based violence on women in Slovakia. Relying on Articles 3 (prohibition of inhuman or degrading treatment), 8 (right to respect for private and family life), 13 (right to an effective remedy) and 14 (prohibition of discrimination) of the European Convention, J.S. complains that she was subjected to inhuman and degrading treatment by her former husband and that the national courts failed to promptly and thoroughly investigate her allegations because, amongst other things, the courts downplayed the violence, and their assessment of evidence was laden with prejudice and stereotypes against ill-treated women. J.S. complains that the State failed to provide her with effective protection from that violence, that the criminal proceedings which had ended in an acquittal could not be considered an effective remedy, and that gender-based violence against women and the lack of its investigation was a systemic problem in Slovakia.
The Court will give its rulings in writing on the following cases, some of which concern issues which have already been submitted to the Court, including excessive length of proceedings. These rulings can be consulted from the day of their delivery on the Court's online database HUDOC.
