Zagadnienie prawne
Czy bezprawne wyburzenie mieszkania, brak należycie uzasadnionych orzeczeń sądów krajowych, naruszenie prawa do poszanowania domu oraz brak skutecznego środka odwoławczego stanowiły naruszenie art. 1 Protokołu nr 1 oraz art. 6, 8 i 13 Konwencji?
W sprawie Mammadova i Mammadov przeciwko Azerbejdżanowi, skarżący, matka i syn, byli współwłaścicielami mieszkania w Baku, które zostało bezprawnie wyburzone, rzekomo z powodu pilnego stanu rozpadu, w celu budowy wielopiętrowego budynku mieszkalnego. Skarżący zarzucają, że orzeczenia sądów krajowych nie były należycie uzasadnione, naruszono ich prawo do poszanowania domu i nie zapewniono im skutecznego środka odwoławczego. W sprawie D.M. przeciwko Szwecji, skarżący, obywatel Afganistanu, przybył do Szwecji w 2015 roku i po kilku nieudanych wnioskach o azyl, otrzymał nakaz usunięcia.

Mammadova and Mammadov v. Azerbaijan (application no. 31618/18) The applicants, Yelena Gennadyevna Mammadova and Zaur Elchin oglu Mammadov, are Azerbaijani nationals who were born in 1966 and 1995 respectively and live in Baku. They are mother and son. The applicants co-owned an apartment situated in the Sabail district of Baku. The case concerns the unlawful demolition of their apartment, which was allegedly in a state of urgent disrepair, in order to make room for a multi-storey residential building. Relying on Article 1 of Protocol No. 1 (protection of property) to the European Convention on Human Rights, and on Articles 6 (right to a fair trial), 8 (right to respect for private and family life) and 13 (right to an effective remedy) of the Convention, the applicants complain that the national courts' judgments in their case had not been duly reasoned, that their right to respect for their home had been violated and that they had not been given a legal avenue providing effective protection against the violation of their rights.

D.M. v. Sweden (no. 32694/23) The applicant, Mr D.M., is an Afghan national. He arrived in Sweden in 2015 when he was a teenager/young adult. The case concerns an order to remove him from Sweden after several unsuccessful applications for asylum. Mr D.M.'s most recent challenge to the deportation was dismissed in 2023. The European Court has, however, stayed his removal until further notice under Rule 39 (interim measures) of its Rules of Court. Relying in particular on Article 3 (prohibition of inhuman or degrading treatment) of the European Convention, Mr D.M. alleges that his removal to Afghanistan would expose him to a real risk of being ill-treated, mainly on account of the general situation in the country, his Hazara ethnicity and area of origin (Mazar-e Sharif in Balkh province), his conversion to Christianity and his so-called "westernisation" after having spent ten years in Sweden.
The Court will give its rulings in writing on the following cases, some of which concern issues which have already been submitted to the Court, including excessive length of proceedings. These rulings can be consulted from the day of their delivery on the Court's online database HUDOC. They will not appear in the press release issued on that day.
