Ratio decidendi

Trybunał uznał, że zasada ne bis in idem z art. 4 Protokołu nr 7 ma zastosowanie, gdy osoba została już prawomocnie uniewinniona lub skazana za 'to samo przestępstwo', co Trybunał interpretuje jako 'te same fakty'. W niniejszej sprawie Trybunał stwierdził, że chociaż oba postępowania dotyczyły prowadzenia pojazdu pod wpływem alkoholu, to jednak kwalifikacje prawne i elementy czynów (actus reus) były różne, a postępowanie karne nie zakończyło się prawomocnym wyrokiem. W konsekwencji, nie doszło do podwójnego ukarania za te same fakty w rozumieniu art. 4 Protokołu nr 7.

Stan faktyczny

Skarżący został zatrzymany 4 kwietnia 2002 r. za prowadzenie pojazdu pod wpływem alkoholu (0,87 promila). Wszczęto przeciwko niemu postępowanie administracyjne, które zakończyło się prawomocnym ukaraniem grzywną i pozbawieniem prawa jazdy na rok na podstawie art. 213 ust. 2 lit. a Kodeksu Wykroczeń Administracyjnych. Równocześnie wszczęto postępowanie karne na podstawie art. 158 Kodeksu Karnego za to samo zdarzenie, jednak nie zakończyło się ono prawomocnym wyrokiem skazującym ani uniewinniającym.

Rozstrzygnięcie

Trybunał stwierdza brak naruszenia art. 4 Protokołu nr 7 do Konwencji. Trybunał zasądza skarżącemu kwotę 9 000 EUR tytułem kosztów i wydatków.
