Stan faktyczny

W 2001 r., krótko przed zakończeniem jego kary pozbawienia wolności, sąd nakazał kontynuację detencji prewencyjnej na podstawie nowelizacji § 67d niemieckiego kodeksu karnego z 1998 r. Ta nowelizacja pozwalała na przedłużenie detencji prewencyjnej poza początkowy dziesięcioletni maksymalny okres, co nie było możliwe na mocy prawa obowiązującego w momencie jego skazania w 1986 r. Skarżący zaskarżył tę decyzję na poziomie krajowym, argumentując, że retroaktywne zastosowanie nowego prawa narusza jego prawa.

Rozstrzygnięcie
