Skarżąca, Chantal Van den Broeck, urzędniczka Komisji Europejskiej, złożyła skargę na decyzję odrzucającą jej zażalenie z dnia 4 listopada 1973 r., w którym domagała się przyznania dodatku z tytułu ekspatriacji. Twierdziła, że warunek dotyczący narodowości w art. 4 lit. a) załącznika VII regulaminu pracowniczego nie powinien mieć zastosowania, gdy narodowość została jej narzucona przez prawo w wyniku małżeństwa z obywatelem innego państwa, a ona nie mogła się jej zrzec.
